Kituwah Global Government Group, LLC (KG3) is the government contracting arm of The Eastern Band of Cherokee Indians (EBCI).  KG3 subsidiaries provide Federal customers goods and services such as: program management, information technology, construction services, logistics, manufacturing, and administrative support services. Benefits of 8(a) Sole Source Contracting

Non-Protestable

KG3 LLC’s have tribal 8(a) status, which offers our customers a sole source procurement method that permits the selection of a qualified contractor of choice to meet emerging program requirements.

Direct Award Up To $25M (Civilian) And $100M (DOD)

13 CFR 124.506(b) provides Contracting Officer can approve up to $25M ceiling for civilian agencies and $100 ceiling for DoD. Ceiling can go higher with approved J&A requirements.

Fast Processing Time

The Tribal 8(a) process reduces procurement times from months and years to weeks depending on the size and complexity of the contract.

Streamlined Process

Contracts can be initiated with a simple high-level Statement of Work. The eligibility of KG3 for a sole source or competitive 8(a) requirement may not be challenged by another participant or party.

Indian Incentive Program

The U.S. government provides a monetary incentive through its Indian Incentive Program (25 U.S.C. §1544) to eligible prime contractors for hiring Native American-owned companies, like KG3, as subconsultants. The program:

  • Offers up to 5% of the amount paid to KG3 returned to the prime contractor after work is completed

  • Requires authorization in the contract

  • Requires that the funds be expended

The Buy Indian Act

The U.S. government gives the Bureau of Indian Affairs (BIA) the authority to set aside procurement contracts for Indian-owned and controlled businesses through The Buy Indian Act (25 U.S.C. §47). The Buy Indian Act regulations are included in the Department of the Interior Acquisition Regulations (DIAR), part 1480. The National Park Service, Bureau of Land Management and other bureaus in the Department of the Interior also may have the authority to set aside procurement contracts under this Act.

The Buy Indian regulations give preference, where authorized and applicable, to the hiring of Native American employees and purchasing of products, supplies and services from eligible Indian Economic Enterprises (IEE). KG3 is an eligible Indian Economic Enterprise.

The Tribal 8(a) Advantage

As a wholly owned and economic instrumentality of the Eastern Band of Cherokee Indians, KG3 is advantageously positioned to operate as part of the SBA 8(a) Business Development Program. We are eligible for FAR compliant (FAR 13 CFR 124.506) sole-source contracts up to $25 million with civilian agencies and $100 million from the DoD. The Tribal 8(a) contract vehicle reduces the procurement timeline from months to weeks, allows for the selection of a qualified contractor of choice, to negotiate costs, gives more control of scope and budget, and the award cannot be protested.
